• 20% surcharge during the festive season from December 20th to January 10th on all of our prices.

CANCELLATION POLICY

For DAY CHARTERS

• Cancellations more than 14 days before the trip
  • Full refund, excluding the non-refundable booking fee and any applicable bank charges.
• Cancellations less than 14 days before the trip
  • The deposit is non-refundable.
• Cancellations less than 7 days before the trip
  • 50% of the total trip cost is non-refundable.
• Cancellations less than 36 hours before the trip
  • The full trip amount is non-refundable.
• Bad weather cancellations (at the captain’s discretion)
  • The trip will either be rescheduled or fully refunded.
• Shared charters
  • If fewer than 8 guests are booked, the charter will be canceled, and you will
    receive a full refund.

For MULTI-DAY CHARTERS

• Cancellations more than 60 days before departure:
  • You will receive a refund of your 20% deposit, minus the non-refundable
    booking fee and any applicable bank charges.
• Cancellations 60 to 30 days before departure
  • 50% of the total charter price is non-refundable.
  • You may reschedule your charter for a future date, subject to availability.
• Cancellations within 30 days of departure
  • The full charter amount is non-refundable.
  • Rescheduling might be possible, but this will depend on availability.
• Bad weather cancellations (at the captain’s discretion)
  • The trip will either be rescheduled or fully refunded.

ITINERARY CHANGES

• The itinerary may change due to weather conditions on the day of the charter. Any such changes do not entitle guests to cancellation or a price discount.
• For charters to Anguilla that are rerouted to a trip around St. Martin, we will either refund the price difference or accept a cancellation.

DAMAGE LIABILITY

• Guests will be held responsible for any onboard damages caused by negligence. Charges for such damages will be applied to the credit card on file.

HEALTH AND SAFETY

• Guests must disclose any medical conditions or physical impairments that may affect their ability to participate in charter activities. Necessary medications should be carried, with their usage and location communicated to the crew.
• Life jackets and other safety equipment provided must be worn as instructed by the crew when conditions require.

RESPONSIBILITY FOR PERSONAL BELONGINGS

• Pyratz Gourmet Sailing is not responsible for loss or damage to guests’ personal belongings. Guests are encouraged to secure valuables and monitor their possessions throughout the charter.

SMOKING

• Smoking is permitted only in designated areas. Guests must follow the crew’s instructions regarding smoking for the safety and comfort of all onboard.

PHOTOGRAPHY AND MEDIA CONSENT

• By participating in the charter, guests consent to being photographed or filmed for promotional purposes. Guests who do not wish to be included must inform the crew at the start of the charter.

CHILDREN AND MINORS

• Parents or guardians are responsible for the safety and behavior of children under the age of 18.

SAFETY PROCEDURES

• Guests must familiarize themselves with the safety procedures outlined by the crew at the beginning of the charter and comply with all instructions during the charter and in case of an emergency.

LEGAL JURISDICTION

Any disputes arising from the charter or these terms and conditions will be governed by the laws of Saint Martin. The parties submit to the exclusive jurisdiction of the courts of Saint Martin.

ACKNOWLEDGEMENT AND ASSUMPTION OF RISK

• Guests acknowledge the inherent risks associated with marine activities, including swimming, snorkeling, and using water toys, and agree to assume all such risks, both foreseeable and unforeseeable.
• By participating in these activities and using the boat and equipment, guests release Pyratz Gourmet Sailing / BOTZ Marine S.A.S., its owners, and employees from any liabilities arising from personal injury.

PAYMENT AUTHORIZATION

• I certify that I am an authorized user of the credit card provided and that I will not dispute any payments.

I, ____________________________________, hereby acknowledge that I have carefully read the cancellation policy along with the terms & conditions of Pyratz Gourmet Sailing B.V. / Botz Marine S.A.S, understand the content thereof, and agree to them voluntarily on my own free will. I also confirm that I am signing on behalf of the entire group of guests
